Not everyone qualifies for the T-visa. People who qualify must be:
- A victim of a “severe form of human trafficking.” The purpose of this law is to help victims; thus, only victims are eligible for a T-visa.
- In the U.S. as a result of human trafficking. The crime itself has to be what brought them into the country or it needs to explain why they are still physically present in the U.S.
- Able and willing or have already complied with attempts by law enforcement to seek justice. This means reporting the trafficking and potentially helping with the investigation and/or prosecution of the perpetrator(s). This is the case for victims who are over 18, for situations where the level of help requested is reasonable, and in cases where the victim isn’t held back from helping due to trauma.
- Able to show that removing the person from the U.S. would cause the victim an extreme level of hardship.
- Normally able to enter the US as a nonimmigrant, which means the victim hasn’t triggered any inadmissibility grounds under immigration law. If you are not, you will need to submit Form I-192, Application for Advance Permission to Enter as a Nonimmigrant.
In addition, the trafficking has to be a “severe form of trafficking in persons” as defined by the government. This includes both sex trafficking and labor trafficking.
